Phục Hồi Bằng Bị Treo (License Reinstatement)
Phục hồi bằng bị treo không phải một form duy nhất. DUI case có court, DMV admin action, IID và SR-22 chạy song song. Nếu lapse xảy ra chiều thứ Sáu, hãng gửi SR-26 rồi DMV có thể treo lại trước khi cô chú bác kịp gọi thứ Hai. Luật sư DUI xử court; tôi xử phần filing đúng carrier, đúng tên, đúng ngày.

Thời gian xử lý
Sau khi tất cả requirements met và payment processed, license reinstated trong 5-10 ngày. Nếu DUI, có thể phải đợi additional waiting period.
Tài liệu / Yêu cầu
- Underlying suspension cause cleared (vé chưa pay, accident judgment, DUI program completed, etc.)
- SR-22 filed by carrier if DMV/court requires proof of financial responsibility
- DMV reinstatement/reissue application completed if listed on the notice
- Reinstatement fee paid
- Proof of completion any required programs (DUI school, anger management, etc.)
- IID installed if DUI (mandatory since 2019)
Các bước thực hiện
- Bước 1: Find out reason for suspension, go dmv.ca.gov/portal/driver-record hoặc gọi 1-800-777-0133.
- Bước 2: Address underlying issue: pay fines, complete DUI program, satisfy court judgment, file SR-22 if the notice requires it, etc.
- Bước 3: Nếu DMV yêu cầu SR-22, choose insurance carrier có filing và xác nhận effective date không lapse.
- Bước 4: Have carrier file SR-22 với DMV, processing time tùy carrier/DMV.
- Bước 5: Install IID only if conviction/restriction path requires it. Choose state-approved provider, list at dmv.ca.gov.
- Bước 6: Submit reinstatement/reissue application and fees according to DMV notice.
- Bước 7: Wait 5-10 ngày for reinstatement confirmation.
- Bước 8: Print confirmation và keep with license. Plastic license vẫn valid nếu chưa expire.
Lỗi thường gặp
- SR-22 lapse while DMV still requires proof can trigger re-suspension. Carrier reports cancellation/lapse to DMV.
- DUI program incomplete, phải finish full course (3 tháng AB541 minimum) trước khi reinstate.
- Multiple suspensions stacked, phải clear EACH suspension separately, each has own fee.
- IID violation, failed start, missed test, removed device → mandatory extension of suspension.

Nếu DMV yêu cầu SR-22, premium thường tăng mạnh và filing phải giữ liên tục theo notice. Không phải mọi suspension đều cần SR-22; agent phải xem DMV letter trước khi quote để tránh file nhầm hoặc thiếu filing.
