Chuyển Tên Xe (Title Transfer)
Mua xe trong cộng đồng qua người quen nghe yên tâm, nhưng title vẫn phải sạch. Tôi đã thấy hồ sơ ở Garden Grove kẹt chỉ vì lien release chưa có chữ ký bank. Carfax khoảng $40 là tiền nhỏ so với một xe salvage bị giấu. Family transfer giữa vợ chồng, cha mẹ con cái có thể dùng REG 256 để ghi rõ quan hệ và xem gift exemption.

Thời gian xử lý
Tại DMV: 30-90 phút nếu hồ sơ đủ. Title mới gửi qua mail sau khi DMV xử lý. Buyer phải report/submit transfer trong 10 ngày từ ngày mua (CVC §5902) để tránh penalty.
Tài liệu / Yêu cầu
- Title gốc từ seller, Section 1 (transfer) phải có signature seller, Section 5 (buyer info) phải fill
- Bill of sale (REG 135 hoặc letter)
- Odometer disclosure (xe dưới 10 tuổi)
- Smog certificate nếu DMV yêu cầu; private seller thường phải cung cấp certificate hợp lệ trong vòng 90 ngày, trừ exemption
- Bằng lái
- Money order hoặc cashier's check cho fees + tax
Các bước thực hiện
- Bước 1: Inspect title carefully, make sure VIN match xe, không có liens chưa release.
- Bước 2: Seller fill Section 1 (release of ownership) trên title.
- Bước 3: Buyer fill Section 5 (new owner info).
- Bước 4: Dùng REG 262 nếu cần odometer/power of attorney hoặc dealer reassignment; nhiều hồ sơ private-party chỉ cần title đúng chữ ký.
- Bước 5: Buyer go to DMV trong 10 ngày, bring all documents + payment.
- Bước 6: Pay use tax (sales tax) tại DMV, based on purchase price, NOT NADA value (nhưng DMV có quyền challenge nếu giá quá thấp).
- Bước 7: Receive new registration card và sticker.
Lỗi thường gặp
- Title có lien holder chưa release, không thể transfer. Phải có lien release letter từ bank/finance company TRƯỚC.
- Listed price quá thấp ($1), DMV có quyền charge use tax based on Kelley Blue Book value thay vì stated price (gift exception applies cho family transfer).
- Quên smog cert, phải redo trip, lose time.
- Quá 10 ngày, DMV có thể tính penalty; amount phụ thuộc loại phí và thời gian trễ.

Khi mua xe used, bind policy trước khi lái xe khỏi nhà seller. Tôi thường để policy mới effective ngay giờ giao xe, rồi xử lý xe cũ sau khi bill of sale xong để không bị lapse hoặc double-insure quá lâu.
